Terms & Conditions

These Terms & Conditions govern your use of the websites operated by the WA Sporting Car Club Inc. (“WASCC”, “the Club”, “we”, “us”, “our”) at wascc.com.au and wannerooraceway.com.au (together, “our websites”), and your participation in Club membership, events and activities conducted on or from Wanneroo Raceway.

By accessing our websites or participating in any Club activity, you agree to be bound by these Terms & Conditions and our Privacy Policy.

1. About the Club and Wanneroo Raceway

The WA Sporting Car Club Inc. is an incorporated association registered under the Associations Incorporation Act 2015 (WA). The Club operates Wanneroo Raceway and conducts motorsport events, club activities and venue services in Western Australia.

The Club is an affiliated member of Motorsport Australia (the Confederation of Australian Motor Sport Limited) and conducts events in accordance with the Motorsport Australia National Competition Rules (NCR) and applicable supplementary regulations. The Club also conducts and hosts events under other sanctioning bodies and permit-issuing organisations. The applicable regulations and permit conditions for each event are set out in that event’s supplementary regulations.


2. Membership

2.1 Membership Application

Membership of the Club is subject to acceptance of your application by the Club committee, payment of the applicable membership fee, and agreement to these Terms & Conditions and our Privacy Policy. Membership is not confirmed until the Club has accepted your application and received payment.

2.2 Membership Obligations

As a member of the Club, you agree to:

  • Abide by the Club’s constitution, by-laws and rules as amended from time to time;
  • Conduct yourself in a manner consistent with the values of the Club and motorsport generally;
  • Keep your contact and personal details current with the Club;
  • Pay membership fees by the due date;
  • Comply with all Motorsport Australia regulations and any applicable permit conditions at Club events.

2.3 Membership Communications

By becoming a member of the Club, you will be enrolled on the principal membership communications list used to deliver important Club notices and communications. You may choose to unsubscribe; however, the Club cannot be held responsible or liable if you miss important communications as a result. Please refer to our Privacy Policy (Section 3) for full details.

2.4 Membership Fees

Membership fees are set annually by the Club committee and are published on our website. Fees are generally non-refundable once a membership period has commenced, except where required by applicable law. If you have a query about a membership fee payment, please contact the Club office.


3. Event Entry and Participation

3.1 Motorsport is Dangerous — Enter at Own Risk

WARNING: Motorsport and related activities are inherently dangerous. Participation in any event, activity, practice session, test day, or other activity at Wanneroo Raceway — whether as a driver, rider, navigator, co-driver, passenger, crew member, official, marshal, or in any other capacity — involves significant risk of serious injury or death to yourself and others, and risk of damage to property.

By entering Wanneroo Raceway premises or participating in any event or activity, you acknowledge these risks and agree to participate entirely at your own risk.

3.2 Conditions of Entry

Participation in events conducted by the Club or at Wanneroo Raceway is subject to:

  • Completion and submission of the required entry form for the relevant event;
  • Payment of the applicable entry fee;
  • Holding a current and valid licence, permit or credentials as required by the applicable permit-issuing body or event supplementary regulations;
  • Compliance with all applicable event regulations, supplementary regulations, and the directions of event officials;
  • Execution of all required waivers, indemnities and disclaimers; and
  • Presenting a vehicle compliant with the applicable regulations and class requirements.

3.3 Waivers and Indemnities

All participants — including but not limited to drivers, entrants, crew members, officials and volunteers — are required to execute a full waiver and indemnity before participating in or assisting at any event. The form and content of the required waiver will depend on the permit-issuing body for the relevant event:

  • For events conducted under a Motorsport Australia permit, the required waiver is the Motorsport Australia Disclaimer and Indemnity, which is a mandatory condition of the Motorsport Australia National Insurance Program.
  • For events conducted under the permit of another sanctioning body (such as AASA or another governing organisation), the waiver required by that body will apply.
  • For events organised by third-party hirers at the venue, the relevant waiver will be specified by the event organiser.

By submitting an event entry, you confirm that you have read, understood, and agree to all applicable waivers and indemnities for that event. These waivers form a mandatory part of the conditions of your participation and are required for insurance coverage to apply.

3.4 Data Sharing with Permit-Issuing Bodies and Insurers

By entering any event at Wanneroo Raceway, you consent to the disclosure of your relevant personal information — including name, licence or permit details, vehicle details, and waiver records — to the applicable permit-issuing body and its nominated insurers as required for that event. This may include Motorsport Australia, other sanctioning bodies, or the insurer of a third-party event organiser, depending on the event. See our Privacy Policy (Section 4.2) for full details.

3.5 Entry Fees

Entry fees for events are set by the Club or the relevant event organiser and are published in the applicable supplementary regulations or on our website. Entry fees are generally non-refundable except where an event is cancelled by the Club or organiser, or as otherwise required by applicable law. Where a specific refund policy applies to an event, it will be stated in the supplementary regulations for that event.

3.6 Participant Conduct

All participants must conduct themselves in a safe, respectful and sportsmanlike manner at all times on Club premises. The Club reserves the right to exclude or remove any participant, crew member or official whose conduct is unsafe, disrespectful, or in breach of these Terms & Conditions or applicable regulations, without refund of entry fees.


4. Photography and Video on Premises

Wanneroo Raceway hosts events and activities conducted by the Club, as well as events organised by third-party hirers, promoters, and other organisations. By entering or being present on WASCC or Wanneroo Raceway premises — in any capacity — you acknowledge that you may be photographed or filmed by the Club, third-party event organisers, authorised media, sponsors, or other parties present at the venue.

Photography and filming by the Club may be used for the Club’s promotional and marketing purposes. Photography and filming by third-party event organisers or hirers is outside the Club’s control and is subject to the relevant organiser’s own policies. If you have a concern about photography at a third-party event, please direct your enquiry to that event’s organiser.

5. Online Payments

Online payments through our websites are processed by Stripe. By making an online payment, you agree to Stripe’s Privacy Policy and Services Agreement.

We do not store your full payment card details. We retain only a Stripe Payment ID and the last four digits of your card for reconciliation purposes. See our Privacy Policy (Section 6) for full details.

Where a payment is disputed or a chargeback is initiated, we reserve the right to provide relevant transaction records to Stripe and our financial institution in accordance with applicable payment dispute processes.


6. Acceptable Use of Our Websites

You agree not to use our websites to:

  • Submit false, misleading, or fraudulent information;
  • Impersonate any person or entity, or misrepresent your credentials or club membership;
  • Infringe the intellectual property rights of the Club or any third party;
  • Transmit spam, malware, viruses, or other harmful code;
  • Scrape, crawl, or harvest data from our websites without our written consent;
  • Interfere with or disrupt the operation of our websites or their underlying infrastructure;
  • Engage in any activity that is unlawful under applicable Australian law.

We reserve the right to suspend or terminate your access to our websites if you breach these conditions.


7. Intellectual Property

All content on our websites — including text, photographs, graphics, logos, layout, video and code — is the intellectual property of the WA Sporting Car Club Inc. or its licensors and is protected by Australian copyright law. You must not reproduce, distribute, modify, or commercialise any such content without our prior written consent.

Content published on our websites is for informational purposes relating to Club activities and Wanneroo Raceway. It is not republished or made available for third-party distribution without the Club’s explicit permission.


8. Disclaimer of Warranties

Our websites and their content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no warranties, express or implied, regarding:

  • The accuracy, completeness or currency of any information on our websites, including event schedules, results, and membership information;
  • Our websites being available, uninterrupted or error-free;
  • Our websites being free from viruses or harmful code.

Event information, schedules and regulations published on our websites are subject to change. You should always refer to the official supplementary regulations and official Club notices for definitive event information.

Nothing in these Terms & Conditions excludes, restricts or modifies any right, remedy, guarantee, warranty or other term implied or imposed by legislation (including the Australian Consumer Law) where doing so would cause all or part of a provision to be void.


9. Limitation of Liability and Assumption of Risk

Motorsport and related activities are inherently dangerous. By entering Wanneroo Raceway premises or participating in any event or activity — whether as a driver, rider, navigator, co-driver, passenger, crew member, official, marshal, spectator, or in any other capacity — you voluntarily assume all risks associated with that activity, including the risk of serious injury, death, and property damage.

To the maximum extent permitted by law, the WA Sporting Car Club Inc., its committee members, officers, employees, volunteers, contractors, and Wanneroo Raceway shall not be liable for any direct, indirect, incidental, consequential, special or punitive loss or damage arising from:

  • Your use of or inability to access our websites;
  • Errors, omissions or inaccuracies in content published on our websites;
  • Participation in — or attendance at — any motorsport event, activity or practice session conducted at Wanneroo Raceway, whether organised by the Club or by a third-party hirer;
  • Loss or damage to vehicles, equipment or personal property on Club premises, except where directly caused by the Club’s proven negligence;
  • Any act or omission of a third-party event organiser or hirer using the venue;
  • Any third-party website linked from our websites.

Nothing in these Terms & Conditions limits or excludes any liability that cannot be excluded under applicable law, including under the Australian Consumer Law and applicable personal injury or consumer protection legislation in Western Australia.


10. Third-Party Links

Our websites may contain links to third-party websites, including Motorsport Australia, affiliated clubs, sponsors and other organisations. These links are provided for convenience only. We do not endorse or accept responsibility for the content, practices or privacy policies of any linked third-party websites.


11. Governing Law

These Terms & Conditions are governed by the laws of Western Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia for the resolution of any dispute arising out of or in connection with these Terms & Conditions or your use of our websites or participation in Club activities.


12. Amendments

We reserve the right to amend these Terms & Conditions at any time. Updated versions will be posted on our websites with a revised “Last updated” date. Continued use of our websites or participation in Club activities following any amendment constitutes your acceptance of the updated Terms & Conditions.

14. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.


15. Entire Agreement

These Terms & Conditions, together with our Privacy Policy and any event-specific supplementary regulations, constitute the entire agreement between you and the WA Sporting Car Club Inc. with respect to your use of our websites and participation in Club activities.
